Representative Experience:
Defending manufacturer’s transportation department and driver in personal injury and death claims arising out of interstate collision between tractor trailer and minivan carrying six occupants. The representation included the trial of minor child’s claims for traumatic brain injury resulting in significant permanent injury.
Defending insurer in commercial litigation brought by premium finance company.
Obtained summary judgment in federal court for manufacturer sued by supplier alleging breach of a requirements contract for component parts. Claimed damages exceeded $1 million.
Represented Kentucky conveyor manufacturer in $8 million claim alleging commercial loss at manufacturing facility; majority of claims dismissed on summary judgment in federal court; remainder of case resolved for nominal sum.
Obtained a defense verdict for medical device manufacturer in jury trial in Kansas City, Missouri, against allegations of design and warnings defects leading to permanent injuries.
Achieved a unanimous defense verdict for manufacturer of exercise equipment in Kansas state court action involving allegations of design and manufacturing defects.
Local, regional and national counsel to product manufacturers in fire losses and other product liability matters involving claims of defects in design, manufacture and warnings of industrial and consumer products.
Obtained dismissal of tractor manufacturer in wrongful death claims allegedly caused by failure of equipment to include roll over protection system (ROPS).
Represented recreational boat component part manufacturer in trial of wrongful death action arising out of carbon monoxide poisonings allegedly caused by defects in design in which jury was asked to award over $200 million.
